Energy

Energy Efficiency Directive, Article 12

Data centres with at least five hundred kilowatts of installed IT power report annually[src], against a schema of twenty-four data points fixed by Delegated Regulation (EU) 2024/1364[src]. Returns are due each 15 May[src].

The reported indicators are Power Usage Effectiveness, Water Usage Effectiveness, Energy Reuse Factor and Renewable Energy Factor[src]. Member States may lower the threshold and may not raise it[src], so national scope is worth checking before assuming a facility is out of it.

Our systems produce the full return regardless of size. The Union rating scheme itself is not yet in force, so nothing here claims a rating[draft].

Germany

Energieeffizienzgesetz

Germany goes further than the Directive. Facilities commencing operation from 1 July 2026 must reach a Power Usage Effectiveness of 1.2, with a draft amendment moving that figure to 1.3[src]. The draft would also relax the trajectory for existing facilities to 1.6 from July 2027 and 1.4 from July 2030[draft].

Waste heat is the harder requirement. New facilities must reach an Energy Reuse Factor of ten percent from July 2026, fifteen in 2027 and twenty in 2028[src]. That is a design decision about the secondary side of the cooling loop, made before anything is built.

Facilities

EN 50600

The European standard for data centre facilities and infrastructures, covering power distribution, environmental control, physical security, management and energy efficiency[src]. It is increasingly referenced in public procurement, and it is the frame we design against.

Indicators are defined by the ISO/IEC 30134 series[src], and a value is only meaningful alongside its measurement category[src].

Products

Cyber Resilience Act and the Data Act

The Cyber Resilience Act imposes obligations on products with digital elements: vulnerability handling, a software bill of materials, and security support across the expected lifetime of the product[src]. Every image we ship carries a bill of materials, and every product has a disclosure policy and a security contact.

The Data Act adds design obligations for connected products and switching obligations for data processing services[src]. Where a product contains a radio, the Radio Equipment Directive delegated regulation applies its own cybersecurity requirements through the EN 18031 family[src].

Equipment safety is EN / IEC 62368-1[src].

Claims

Empowering Consumers Directive

Directive (EU) 2024/825 restricts environmental claims that cannot be substantiated[src]. An efficiency figure without a stated workload, standard, measurement point and date does not meet that bar.

This is a constraint we find useful rather than inconvenient. It rules out precisely the comparisons that make vendor claims in this category incomparable with each other.

Artificial intelligence

AI Act

The AI Act applies in phases[src]. Selling compute does not make a vendor the provider of an AI system, though a system placed on the market under our own name can bring obligations with it. Where a customer’s deployment is in scope, the measurement and documentation we ship is designed to support their filing rather than complicate it.

Procurement

Public sector

Green Public Procurement criteria for data centres, server rooms and cloud services are widely embedded in tenders even though they are voluntary. The proposed Cloud and AI Development Act would additionally tie public-sector procurement to Union assurance levels; it remains a proposal[draft].
